HIGH COURT UPDATE 15th November
2005:
This morning the High Court hearing went ahead and the results
are as follows:
The two applications (one by East African Wildlife Society,
Born Free Foundation, David Sheldrick Wildlife Trust, etc.,
and the other by Nature Kenya, the Eastern Africa Environmental
Network, KTF) were joined into one.
The applications were considered by the judge who, importantly,
recognised that the injunction still stands, preventing the
degazetting process from proceeding before a decision is taken
by the High Court.
The Judge then adjourned the hearing to the 24th November
which is 3 days after the national Referendum on the draft Constitution.
My understanding is that lawyers for the County Council and
the Attorney General's Office (on behalf of the Government)
failed to provide their submissions at today's hearing.
This is the very latest and I have not yet had any specific
feedback or reaction from Kenya but I thought you would all
like to know as soon as possible.
I will, of course, post any further news as it comes to hand.
